Arbitration as a method for disputes' resolution in Construction Industry in Sudan

Abstract

Construction industry is one of the major international industries and always takes place as agreat investment which needs huge capitals and wide experience.

Contracts in the construction industry are fundamentals issues however technical support is necessary in all construction contracts for proper conduct adequate outputs.

Usually contracts between different parties (contractor,client and consultant) include rights and obliquation which may not always be in abalance way. This might leads to differiences conflicts and disputes between the parties.

In order to solve such problems, arbitration could takesplace as one of the effective methods of solving these disputes avoiding resorts to courts.

The theortical part of this research comprie of litterateur about the topic abstracted from different reliable references.

Practctical part of the research consists of data compilation from the research population through adopting asystematic random sampling of 50 persons and the analysis was conducted using Spss software.

The results of this research indicates that most of construction projects in Sudan ended with some disputes as

aconsequences of shortcomings in satisfyingproject requirements previously stated in the contract documents.

Also most of the sample in this research agree that arbitration in construction contracts is an effective way to solve disputes and avoid litigation at courts.

It is proved that when engineers are involved in arbitration tribunals this makes it more effective emphasizing the previous assumption technical support importance.

In Sudan its essentially required to have more centres to develope this method of dispute resolution in order to mittigate them.
